Publication of Identity of Offender

In Depth

What is the basic rule about the publication of the name of the youth?
The basic rule is that there will be no publication of the youth’s identity, as that identity should be protected.

What is the rationale behind the basic rule?
Publication of the youth’s name may harm a youth and would make rehabilitation back into the community more difficult.

What are the exceptions to the basic rule?
The youth’s name may be published if:

  • The youth has been found guilty of an offence and is given an adult sentence
  • The youth is at-large and is a danger to others
  • The youth is 18 or older, and is not serving a custodial sentence. In this situation, the youth may choose to publish or give consent to publish his or her name
